The BC Commercial Liens Act allows a lien holder including garages, mechanics, repairers, and warehousers to secure payment for services such as repairs and storage of a vehicle. If payment is not made, the lien holder may enforce the lien by either selling the goods (following the Act’s notice and sale requirements) or, if the debtor agrees, by keeping the vehicle or goods in satisfaction of the debt (following the Act’s notice and sale requirements). The BC Commercial Liens Act and Section 192 of the Motor Vehicle Act also applies where a vehicle is abandoned on private property without the occupier’s consent.
